1. About these terms
Welcome to Harborborne. These Terms of Service apply to your use of harborborne.com and to any purchase you make through the site. By using the site or placing an order, you agree to these terms. If you do not agree, please do not use the site.
Harborborne is operated as a sole trader business based in Australia. The trading name is Harborborne.
References to "I", "me", and "Harborborne" in these terms mean the sole trader operating the business. References to "you" mean the person visiting the site or placing an order.
2. About the products
Harborborne sells heritage inspired apparel and footwear that is manufactured to order by print and manufacturing partners. Tees and hoodies are printed and finished in the United States. Sneakers are manufactured in China. Every piece is made after an order is placed. Nothing is held in stock.
Product descriptions, photographs, and mockups are prepared in good faith and are as accurate as possible. Slight variation in print placement, colour rendering on different screens, and finishing is normal in a made to order manufacturing model and is not a defect. Defects and damage are covered under the Returns and Warranty policy.
3. Prices and currency
Prices shown on the site are in Australian dollars unless another currency is selected at checkout through Shopify's currency display. Prices are subject to change without notice, except that a confirmed order at the price shown at the time of checkout is honoured at that price.
Prices do not include customs duties, import taxes, or carrier handling fees imposed outside Australia. International customers are responsible for those charges.
4. Orders and acceptance
Placing an order through the site is an offer by you to buy the product. Harborborne accepts the offer by confirming the order by email. I reserve the right to decline an order, refund the payment, and cancel an order in cases of obvious pricing error, suspected fraud, unavailability from a production partner, or a reasonable suspicion that the order breaches these terms.

Shipping and delivery terms are set out in the Shipping and Delivery page. Those terms are incorporated into these Terms of Service by reference.
6. Returns and warranty
The Returns and Warranty page sets out how damage, defect, and fulfilment error claims are handled. Those terms are incorporated into these Terms of Service by reference.
7. Australian Consumer Law
These terms do not exclude, restrict, or modify any right or remedy you have under the Australian Consumer Law or any other legislation that cannot be excluded. Under the Consumer Guarantees in the Australian Consumer Law, goods sold through Harborborne must be of acceptable quality, match their description, and be reasonably fit for their purpose. If a product fails any of those guarantees, you are entitled to a remedy depending on the nature of the failure. Nothing in these terms overrides those rights.
8. Intellectual property
Every design sold through Harborborne is an original work created for Harborborne. Designs are inspired by broad historical themes and ship classes, not by any specific vessel, insignia, or trademark of any navy, service, museum, or estate. Where a design references a period, a class, or a historical event, it does so at a general level that does not infringe any live trademark or right of publicity.
If you believe that a design on the site infringes your rights, please contact me at hello@harborborne.com with a description of the concern, and I will respond within five business days. I take these concerns seriously and will act quickly if a change is needed.
All designs, photographs, written content, brand marks, and layouts on the site are the property of Harborborne. You may view and share the site content for personal, non commercial use. You may not copy, reproduce, or use any site content for commercial purposes without written permission.
9. User conduct
When using the site, you agree not to attempt to interfere with site operation, not to use the site in breach of applicable laws, and not to misuse any promotional codes or checkout processes.
10. Limitation of liability
To the extent permitted by law, Harborborne is not liable for any indirect, consequential, or special loss arising from the use of the site or any product sold through it. Nothing in this clause limits any right or remedy under the Australian Consumer Law.
11. Governing law
These Terms of Service are governed by the laws of Victoria, Australia. Any dispute arising from these terms or from your use of the site is subject to the non exclusive jurisdiction of the courts of Victoria.
12. Changes to these terms
I may update these Terms of Service from time to time. The current version is always the version published on this page. Changes apply from the date they are published.
